No interim pay if spouses' earnings equal, clarifies Delhi HC

The Delhi High Court has ruled that interim maintenance cannot be granted to a wife under Section 24 of the Hindu Marriage Act if both spouses have equal incomes. The court stated that the purpose of interim maintenance is to help with litigation expenses and ensure a comfortable lifestyle, not to equalize incomes. The ruling came in response to cross appeals filed by a husband and wife regarding maintenance payments for their child. The court reduced the maintenance amount for the child from Rs 40,000 to Rs 25,000 per month.
