Recoveries from personal guarantees in India are expected to increase significantly following a recent Supreme Court ruling affirming the validity of provisions regarding personal guarantees in the Insolvency and Bankruptcy Code (IBC). Currently, recoveries from personal guarantees are at a low 5.22%. The ruling enables the use of personal assets of guarantors to recover outstanding debt. Delays in the resolution process and low recovery rates have been ongoing challenges in insolvency cases.
