NCLAT sets aside CCI's 6-year-old penalty on ITC for not furnishing info on Savlon deal

The National Company Law Appellate Tribunal (NCLAT) has reversed the penalty imposed on ITC by the Competition Commission of India (CCI) for the corporate giant's failure to notify the CCI for the acquisition of brands “Savlon” and “Shower to Shower.” In its judgment, the NCLAT lifted the Rs5 lakh ($6,683) fine, stating that ITC was exempt from the Section 6 (2) of the Competition Act because the deal’s worth only amounted to INR68.37 crore ($9.13m), falling within the purview of de minimis notification of the Act.
